Orders Validate APEGGA's Role

Following extensive investigations, APEGGA's Compliance Department and Enforcement Review Committee recently proceeded with legal action under the Engineering Geological and Geophysical Professions Act against two unregistered individuals and one company. The concerns pertained to violations of the reserved practice and reserved title provisions of EGGP Act, involving the practice of engineering.

The matters were recently finalized with consent orders for court injunctions being agreed to and obtained in the Court of Queen's Bench of Alberta. Consent orders are binding orders for the respondents APEGGA investigated.

These orders are, in effect, important validations of APEGGA's role in protecting the public though self-governance. Only properly licensed individuals and companies can practice engineering or hold themselves out as engineering practitioners.

UPON HEARING THE WITHIN APPLICATION of the Applicant herein, AND UPON HEARING Counsel for the Applicant herein, AND UPON NOTING consent of Counsel for the Respondent, IT IS HEREBY ORDERED THAT:

1. The Respondent be and is hereby enjoined from engaging in the practice of engineering until such time as the said Respondent is registered to practice engineering as required by the Engineering, Geological and Geophysical Professions Act, 2000, S.A., c. E-11.1, Part 1.

2. The Respondent is enjoined from holding himself out as entitled to engage in the practice of engineering until such time as the Respondent is registered as required by the Engineering, Geological and Geophysical Professions Act, 2000, S.A., c. E-11.1, Part 1.

3. The Respondent is enjoined from using the professional stamp or seal of a professional engineer or licensee, unless the conditions set out in Section 3(2) of the Engineering, Geological and Geophysical Professions Act, 2000, S.A., c. E-11.1, Part 1, are met.
