Appeal BoardDavid Irving, P.Eng., Chair The major objective of the Appeal Board is to act on behalf of Council to provide Association members full protection of their statutory right to appeal and right to natural justice, in accordance with the Act. The Engineering, Geological and Geophysical Professions Act, passed in 1981, allowed members and complainants to appeal Council decisions of the Discipline Committee and Practice Review Board in matters of conduct and practice. A decision by the Board of Examiners to refuse registration can also be appealed.During 1995, the Appeal Board dealt with four appeals of decisions of the Discipline Committee. In two of these appeals, the decision of the Discipline Committee to terminate investigations was appealed by the complainant. The appeal hearings in these cases resulted in a recommendation to Council to uphold the decision of the Discipline Committee. The third case was an appeal by a member of the findings and sanctions of the Discipline Committee. The Appeal Board recommended to Council that the findings and orders of the Discipline Committee be quashed. The final appeal by a member against the decision and orders of the Discipline Committee resulted in a recommendation to Council to uphold the decision of the Discipline Committee. Due to anticipated changes in the Act, the Appeal Board will be utilizing a new public forum in 1996. The Board is looking forward to the challenges associated with this new forum, and welcomes the new Appeal Board legal counsel Paul Sharek, LL.B.
